These Terms of Service govern your use of Memoira ("Service"), operated by Memoira, Inc. By accessing or using the Service, you agree to these terms.

1. Use of the Service

You must be at least 18 years old to create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.

You own all content you create on Memoira — stories, recordings, photos, and memoir chapters. You grant us a limited license to store, process, and display your content solely to provide the Service. We will never sell or share your family's stories with third parties for advertising or AI training without your explicit written consent.

5. AI-Generated Content

Memoira uses AI to generate memoir chapters based on conversations. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and editing chapters before treating them as factual records. Memoira is not liable for inaccuracies in AI-generated memoir content.

6. Data and Legacy Access

On Legacy plans, you may designate family members to access your vault after your passing. This designation is subject to our Legacy Access terms, which will be provided at setup. We will make reasonable efforts to maintain legacy access, but cannot guarantee indefinite service availability.

7. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon deletion, your content will be removed within 30 days, except where retention is required by law or for the Legacy plan beneficiaries you have designated.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Memoira's liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved through binding arbitration rather than in court, except for small claims and intellectual property matters.

11. Changes to These Terms

We may update these Terms from time to time. We'll notify you by email of material changes at least 14 days in advance. Continued use after changes constitutes acceptance.
